Maybe something fraudulent

Today, in my studies of this situation, I observed where I think Diaz is conducting her business in a fashion which, if it is not fraudulent, is very typical of a dishonest business enterprise. Any business which requires ongoing staffing and overhead (as actually all businesses do) cannot afford to offer a "lifetime" membership in good conscience. It is apparent that she is planning to fund these present members' future access and services with the revenues from future subscribers (or anticipating just abandoning them once the money stream dies down and she can abscond with the funds). I am truly surprised that she has not been advised by her attorneys to correct this glaring faulty practice, which, if not dishonest, is certainly representative of poor business planning. In my opinion, the offer and guarantee borders on fraudulent conduct. The mechanism of funding benefits to early participants from future revenues, in effect, is a Ponzi scheme. The "Ponzi" is a classic fraudulent investment mechanism, where early participants are paid dividends from the proceeds of new investors, enticed by the glowing reports of the early ones. Eventually, there are not enough new "suckers" to pay the dividends for the earlier investors and the scheme collapses. Giving lifetime memberships is simply an inappropriate business practice; lifetime service from a one-time small fee is virtually a prescription for eventual bankruptcy. Notice that she has a comparison of the value of her lifetime membership in relation to other programs, which require monthly or, at least periodic, fees (like South Beach, for example). The reason those others require those periodic payments and limited spans of membership, unless you renew, is because a functioning business cannot fund ongoing obligations (which, of course, will require income to maintain) from the fees of future clientele. Like the Ponzi scheme, once the membership reaches a certain level, there wouldn't be enough new clients to fund the operation and it would collapse. So, that's a rather ironic comparison chart... really displaying a tell-tale "too good to be true" promise.

So, as I have given other candid observations about the case, I don't hesitate to provide this one, which to me is really quite troublesome. My advice to her... would be to correct that misrepresentation right away, because that is something that might be a red flag to an attorney general looking into her business activities. I would recommend to the plaintiffs in the civil matter (or maybe this is only something for the Attorney General) that part of the settlement they should seek would be the establishment of an ongoing trust fund to assure a future revenue stream to pay the ongoing expenses.

I think they've managed to not only hit the targeted prey, but will accomplish quite a bit of collateral damage as well.

Thanks, MissMerize for giving me that link. I had read that one previously, as well as all of the other anti-kimmer blogs, prior to making my other evaluations. At this point... although I'm still willing to read more and my mind is always open, the following is my current impression. I
