Thanks. I knew about it posted on Diets in Review but thought that might be a quote from KK and that would be proof she had written it.
It's definitely written to put doubt on TT and most likely to divert attention.

Sure why not ...... TT, SL can help pay the judgment when it's handed down. Heidi's trying to include anyone who "helped" her with the website - giving out advice, etc. (Safety in numbers)?

Lou- My take on things is Heidi Diaz is listed as a defendant and then so is Kimkins.com.
I say this based on the writ of attachment that was filed with Riverside courthouse. The document states the following-
Writ of attachment is appropriate as the claim arose as a Result of Defendant's commercial business
"A Natural person residing in California may have property attached only if the underlying claim arose from the conduct of his or her trade, business or profession." Code of Civil Procedure section 483.010(c)
The defendant may be the primary obligor, alter ego, or guarantor of the primary obligor Randall(1982) 129 Cal.App.3d 757,764.
There is not dispute that kimkins.com is a commercial business. The Kimkins.com website sold contract memberships since 2006 to the general public. In exchange for a fee, Kimkins.com provides dieting advice, dieting consultation, dieting recipes, an open web forum and other services and goods. A copy of the screen shots of the website were attached as exhibits to the Declaration of John E.Tiedt previously filed with this Court"

The Civil code 483.010 would allow the newly acquired house/property to be included in the assets based on the fact that it was purchased from money gained while conducting "business".
Then it goes on to state that Kimkins.com is a commercial business.

Writ of attachment for $1,618,965.22
again to cover the members who would be entitled to a refund.
Assets include
Citibank acct.
Nations back acct.
Real Estate $440,000
Paypal acct-
accounts receivable at kimkins.com

But Heidi has made every attempt to hang on to her money hasn't she?

One method she used was an attempt to apologize on her site to those "who felt misled" by the marketing and she would offer a full refund of the paid membership. Why the change of heart after the recent bannings? Heidi figured out that if she got enough members to take the refund then a class action lawsuit would not take place.

Another method Heidi used to hang on to her earnings was within two days following the writ of attachment hearing she closed an acct that held a mutual fund in excess of $800,000 was closed and the money transferred to another account. She then made an unsolicited payment of $700,000 to the IRS and $100,000 to the California franchise tax board.
This whittled the amount down to $38,000 in that account.

Heidi bought a house for $440,000 and paid cash in the hopes that the property could not be touched I would imagine.

In September Heidi was in the process of trying to hide her money in a trust and in another business that she had just set-up under the name Halcyon. She also set-up a plumbing business for her eldest son, but he is not a licensed plumber. So she is trying to use that money so the members can not be refunded.

Another move that Heidi tried was she emailed all members previous and current. She stated that kimkins was under new ownership. In the deposition she admitted under oath that that was a lie. I guess she thought it would deter us enough to give up...pfft as if!

At this point, as you can see, she has attempted to not be parted from her ill gained money. But John Tiedt is a sharp one and he knows she is trying to pull out every trick in the book.

At this point I am not sure what the total dollar amount Heidi has left over-
$440,000 + $38,000 we know for sure.
But man she is working at trying to keep that money.

So, only her current accounts could be seized at the time? Apparently, the courts haven't forbidden her from just going to another bank and opening a new personal account (?). Am I reading that correctly?

ITA!!! It's a "look over there" diversionary tactic. She does it on a pretty regular basis.

Oh that is soooo cute. You will remember that incident until the day you die. Be sure and write it down somewhere so when she is older you can remind her of what she said, etc.

I don't believe for a minute that she would have payed those income taxes if this lawsuit hadn't come up.

Aww, that's so cute.
(Just as a head's up for you.lol) You're in for it when she finds out where babies come from. I had told my daughter all of it except how the sperm gets delivered to the egg (all in good time and all that. lol). A friend of hers filled her in at a slumber party and she came to me fully expecting me to tell her that her friend had lied to her. She wasn't thrilled to find out she hadn't. That was a couple of years ago and she's *still swearing she's not getting married and doing *THAT, ever!

I believe that is true, but I will ask DH. He's a tax CPA. I think that if you earned it, you owe taxes on it. The government doesn't care if you lost it after the fact.

Honey,

Your daughter sounds adorable. I had a 2nd grader (little boy) come in from recess a few weeks ago all dejected. When I asked him what was wrong, he wailed that his life was over because his girlfriend had just broken up with him. Poor baby. It was cute and sad all at the same time!

That sure would be crushing - no money left over but you owe all the taxes. No wonder she paid them upfront. I wonder if she paid off the student loan judgment. Gosh I wonder what the property taxes are on that new home.

I still think that $700K is a lot of taxes against $2M income - but maybe not! That $2+M gross is before she deducted her business expenses (i.e. salaries to herself, alias, Brandon, website costs, etc.)

LOVE it! Wonder what TT's paying members think of that. Maybe his post will be deleted before too many see it. (Was this posted on TT's site?)
