I do know all benefits stop if she gets thrown in the clink. She might be able to re-qualify when she gets out, just based on her age. I feel strongly that someone needs to send those KTLA clips and the PI tapes to H's local SSA office, but perhaps Attorney Tiedt (sp?) has already taken care of that. Those tapes clearly show that the woman does not meet the SSA's definition of "disabled." (IMO, at least.) It's important to do it now, because IIRC, she will hit the "magic age" of 50 next May!

if she goes to jail--all benefits will stop---because the government is paying for her room and board anyhow

but I deal with this everyday in my line of work---once you get through the initial process of qualifying for disability---very few have trouble getting it reinstated ---for whatever reason is was stopped

I work with clients who have worked full time jobs for several years before the SSA caught up with them and they were still collecting their SSDI and/or SSI payments

they quit work, reapply for reinstatement and SSA withholds a % of their check for over payment--I know one particular client whose family kept receiving his benefits while he was in prison for a year---for the past 10 year's been paying that back--at $20/mth

mental health disability is harder to obtain but much easier to reinstate---the records are usually pretty solid---not only from your own docs but the ones SSA sends you to

it's not the best system in the world but it's all we have at this time---

not everyone abuses the system----most have to decide whether they will eat or buy their meds---most of my clients receive SSI--which in the state of Alabama is only $564--ever tried to live on that---

sorry---went off on a wild tangent ---climbing down off the soap box now

back to Heidi---the fight is going to be long--but she will be made to pay-one way or another--but unfortunately losing her disability is most likely not going to happen....

You assume she got it rightfully to begin with. Why would we assume THAT? What is she on disability for anyway? I know she has given a long list of ailments and psychological problems, but I remember seeing her say somewhere that she was on disability due to heart problems. Whatever's wrong with her (black) heart, it hasn't kept her from setting up a very profitable, albeit CRIMINAL, business. Bottom line: she's a con artist. She's conned folks about being a foster mom, and I would fully expect that she conned her way into disability benefits. I imagine they'll be taking a close look at her. If she's discovered to have gotten her benefits fraudulently, her benefits will stop.

Didn't mean to come off so harsh! Your info is super helpful. Do you know if they do criminal prosecutions of folks for welfare fraud, the kind that can land a person in jail?

Well I Googled that myself, and ran across this article in the Sacramento Bee:

A Cameron Park couple who own an art gallery in El Dorado Hills were indicted by a federal grand jury Wednesday for allegedly claiming disability insurance benefits while continuing to work.

Mary Margaret Donnelly, 54, and Michael Galen Donnelly, 48, were charged with conspiring to defraud the Social Security Administration of disability insurance benefits, according to a news release by the office of U.S. Attorney McGregor Scott.

The pair allegedly claimed to be disabled and not working from 2002 to 2007, according to the eight-count indictment. But during that period, both defendants were working 35 to 40 hours per week at their El Dorado Hills fine art gallery, Our House Defines Art.

The couple also allegedly made several false statements to a government agency in an effort to further the scheme and used more than $70,000 in disability benefits that they were not entitled to, the indictment states.

If found guilty, the pair could face a maximum of five years in prison, the release states.

I've forwarded those links to April, along with a few others I found. Hopefully, she will be able to get them removed. I've also encouraged her to consider writing an article warning folks about the dangers of Kimkins.

the clients I work with have severe mental illnesses---bipolar, schizophrenia, etc, the psych docs and therapists really pad their files in my opinion---to make sure they continue their benefits---but most of my clients have the mental health center as their assigned payee---so of course they want to make sure the benefits are continued--they get the money ---as well as federal subsidies

I've even had to attend some of the hearings with the SSA docs with clients---the one in B'ham does not play around--it usually takes 3 or more years to be approved---and some then only if they get an attorney---

ETA: this is why when the news cast came out about Heidi's assets I sent that info to the Inspector Generals office----see how Heidi lives with no income at all----

Well, I get SSD, but not SSI. Yes, it doesn't stretch very far, but I've managed for several years.

When one turns 50, the SSA apparently considers one too "elderly" to be retrained in a new line of work.

I think Heidi has proven that she has quite advanced computer skills, and very possibly could work from home. I have a couple of friends who do that. That was why I thought they would be interested in seeing how "active" Heidi can be, and also hear the PI's comment about the long hours she works at her computer. Sorry if I went off on a wild goose chase.
