It summarizes by saying that a class action lawsuit must prove that there is substantiated interest in a suit of this size. Um...yeah I think they can prove that too.

It also needs to be said, that I have very much enjoyed reading this tripe, they call a demurrer, on accouta, I could have done a better job. Yikes! It's just a whole bunch of "Hey look over there." I believe too much in jinxes, however, with this shmuck representing her, it seems the case is going to play out just like we'd like it to. Please read it when you get a chance. Then cross reference the examples they give. It's very entertaining.

I'm not good at reading this stuff but I think it also said that 11 people were not enough for a class action and that they needed to prove they had health problems...We know there are more than 11 but if you haven't signed up yet for the lawsuit...do so!!

Well here's what I understand about it and maybe Jeanessa can tell us more...but what I get from this comment :

The procedure for filing a class action is to file suit with one or several named plaintiffs on behalf of a proposed class. The proposed class must consist of a group of individuals or business entities that have suffered a common injury or injuries. What that says to me, is while everyone may not have joined the suit at this time, the lawsuit can still be filed and tried as though they have. This is like when you get a refund check from a company that you never asked for as part of their judgement to settle the class action suit you had no idea of. Also this says a "group" of people, last a checked a group was more than 3 so it is in fact a group. Further explaining that her atty is a dummy <---that's technical lawyer speak there.

Crud I also meant to address the health issue comment. In the court of law "injury" pertains to either personal or monetary. Meaning all who joined kk and were banned from the LIFETIME membership WERE injured, they were injured monetarily. The literal translation would lead one to believe that it meant health issues, however the legal translation pertains to the monetary loss, hence the suit is legit.

What that means is it's apparently standard practice to file the demurrer, and pretend the case has no merit. So it seems everything is right on track. And again by the time John and Jeanessa and the group make it to court in I believe March, think of how much more info we can have for him based on the stuff Heidi continues to do? You know like the "new" b/a pics she has? Uh, we know for a fact that pic is not a current one, unless they used the best lighting on the planet in it. That's likely her before back 7 yrs ago when she tried to diet in the first place. Just my opinion...but honestly, I'm sure there's a mountain of stuff John is compiling, for this reason

Yes, she did. She told me the adrenal nodule they also found should be closely watched, even if it's benign, because it could release hormones that affect other issues (such as blood pressure and cholesterol). I gave her the benefit of the doubt when she came here about the calls despite my feelings. For some reason I feel almost guilty for doubting her even though the evidence at hand, and past experience, says she's full of it. But, I guess I'm learning and I will eventually be a better judge of character.
