I'm cuter, I've been doing everything I can to obtain the assesment of the property, but I'm hitting some snags. Trust me, I've got all my contacts on it. Where I live you can pull assessment by name, seems you can't do that in riverside county. Damn!!! Also here the assesment has a pic of the property, including an air view! But, the fact that I'm nice and wish to not start another flame war, when I find it, WHEN, I will black out the address

Rats! Not to you, Honey and Kisal, but to the Demurrer paper. All it takes is a judge to rule. There's a saying - Innocent men choose a judge, the guilty a jury. All it highlights is that a jury is harder to convince unanimously than a single person. Hey, does this mean the soap opera has a new lease on life? I wanted my life back!

Then the amount the buyer gives you HAS to cover that amount. Does that make sense?

That being said she paid cash for it. So in fact she could sell it to someone for $100 bucks, however, knowing what we know now, even if she did that, we'd be on it, and then the lawyers would be on it as well.

As far as selling the house and being made to sell the house. Let's say she's found guilty, and she's fined 2 million dollars. In theory she would have to liquidate everything she has to come up with 2 million dollars. If in fact she can do that and still keep the house, then she won't have to sell it. But since this case is based on fraudulent business practices, she will likely have to return all of the money, hence the home goes bye bye as well.

Whew, that was wordy. Now you have enough knowledge to be a mortgage broker as well

ETA: oops, I know Doodle hates when I do this, but...I forgot to add. I did some more searching on the property last night, and from what I can tell, and I can't find the concrete proof right now, the house that she bought was either on the forclosure list or getting ready to be on it. Hence it was on the market for some time. Now in theory if she has to sell the house, she will likely take a hit financially, because if she gave asking price for a home that's been on the market at least 8 mos, she's not gonna sell it for more than that, probably not even for that. Hence, she takes another hit. On a lighter note, someone will get that property for a pretty fair price if she's forced to sell.
Ok that makes sense. Thanks for clearing that up for me. The only concern I still have is that she will somehow weasel out of giving up that house. Paying cash assures her the upper hand in how it is liquidated. Hmmm. Maybe she is smarter than we thought

It is my understanding that Heidi will not be able to sell or refinance the house with the lien on it.

I believe the lien will remain and the funds will be frozen until the case is settled.

To me, it seems that dragging things out may not be to her advantage.

If she is found guilty and has to liquidate, are there any stipulations as to how much she has to sell the house for or to for that matter? Heck she could sell that house to a relative for $1.00 and never have to give it up it would seem. Maybe I am overestimating her ability to defraud, but I didn't think she could have done some of the things that have come to light recently either.

since the house was attatched she can't sell it to anybody right now. After the lawsuit is settled she will need to come up with whatever amount the judge says she has to pay so she can't just sell the house for asy $1 cause the lien has to be settled before the house can be sold and no new owner would want to be finaicially responsible for the lien

SoCal is crashing hard and Corona is not a desirable area. It smells like cow manure, tends to be triple digit heat during the summer and is a miserable to commute to Orange County or LA. You can now buy houses here in San Diego in the $300s, so I'm betting you could in Corona, too. That said, I doubt Heidi would deny herself when she has the money.

That can take as little as 3 days. However, my point was that it takes usually 7 days for the note to be recorded at the court house, so while she may have begun the transaction last month it likely closed the week prior to the depo. Still ballsy if ya ax me
Since Heidi raised Brandon to be who he is, she's being herself in not trusting him to not walk off with the house right under her nose! And she's doing what I would do NOW - fund a place to live until this miserable case drags to a sorry conclusion for somebody.

That means 1. Heidi bought the house at a bargain price.
2.With the subprime mortgage meltdown currently underway, even that amount will be difficult to realize back, unless those CA fires wipe out so many houses that people get desperate for housing. Or unless the economy takes a sharp upturn.
3. Meanwhile, she's got a decent place to live for who knows however long, likely the best she's ever been in, and way better than a barred cubicle and orange jumpsuits.

Thanks Missi, Becky, and 2big for this info. Do any of you (or anyone else) know if in California law there's any kind of "homestead exception" that might shield the house (or a portion of its proceeds on sale) from the lien?

One the one hand, I hope there IS, because I hate to think of someone innocent losing a lawsuit and losing their home. HOWEVER, in this case, I have no qualms with imaging Hidey without her spiffy new house and cars. lol

Just ordered from Netrition

Just wanted to thank our "goodest friend Tippy" . I just placed an order for some DaVinci SF egg nog syrup and Carbquik mix. When I Googled Carbquik it came up on Amazon. I order lots of stuff through Amazon and would've been tempted to do so again since they provide great service.

But, then I noticed the Netrition link, thought of Tippy, and decided to place my order there, instead of Amazon.

Tippy-kins, whenever I think of you, I just do this -

Tippy - bless her heart!

Here's the top view of the home. I can't get any closer cuz it's never been posted on the net Note she's next to the house with the pool. Now ya'll be good kids and tell me if for any reason you can see the address, and if so, I'll pull it. But I think I've hidden that fact
