Oh, I agree. It wasn't an "oops" at all. Please don't think that for a single second that I am giving her any benefit of the doubt. She was wrong, and she knew it. Now she is having to pay the piper. So much for being "judgement proof." She's lost a lot more than any amount of money can ever make up for.

I was agreeing that it would be easy to say "poor kimmer.. she's got issues..I feel bad that all this has happened" you know?

Nope. I didn't think that at all. However, I used to think "poor Kimmer" when she was a regular poster here. I thought some folks were just plain cruel to her. Hah! Little did I know....

I agree. As if we haven't heard the ketosis argument before. You could barely hear what the doc was saying. The fake sound effects were irritating, like watching a cartoon. But during the real show you could hear little gasps and stuff.

OK, can there still be a lawsuit if she is offering refunds now??? Couldn't she just say 'well I'm offering refunds!'..? Or is the purpose of the lawsuit not to just get refunds but to get it shut down? But then couldn't she just start another site?

You could look at the refund offers as a type of settlement agreement. Should you accept the refund then you would no longer be part of the lawsuit. She's trying to let the air out of the lawsuit so to speak. From what Jeanessa has written, John must think that the lawsuit can continue with those people who refuse/do not request a refund as plaintiffs.

I don't think the lawsuit alone could get the site shut down. I think that will take a criminal prosecution. But the a successful lawsuit could include an award of punitive damages over and above the membership costs. That financial burden could force her to take down the site if she can't afford to maintain it.

Oh and "Sigh-Lum husks?" I wonder if I told her how to pronounce it, if she'd spell it silly-um?
