You're right. The actual party named to be deposed has to be there to give testimony under oath. A court reporter is there and a transcript is created. These days, they are often also videotaped. Your attorney can attend with you to "defend" during the deposition. The purpose of a deposition is fact-finding in order to narrow the issues for litigation. This is the "Discovery" phase of the case, between filling and trial. Either side can depose parties, issue written interrogatories (questions the have to answer in writing) and Requests for Documents.

When this phase is over, Hidey's attorney will probably file a Motion to Dismiss the suit. If not, they'll go to pretrial hearing and set a date for trial. All during this time the Court will be encouraging settlement. Some jurisdictions send certain cases to Alternate Dispute Resolution - mediation, arbitration, etc.

Also, at some point early on, the Judge will decide whether the Plaintiffs should be certified as a "Class" for a class action suit. IF they are not, they can still proceed as a group of individually named Plaintiffs.

There can be many stalls along the way, so I anticipate this will take quite some time to resolve.

Oh, I was frustrated, too, watching that show...Grrrrr....No one seemed to be listening, or to have read the book - except Dr. Weil. Jillian obviously didn't read the book, because she accused Taubes of touting a "diet without exercise" as a way to sell books. Sheeesh, it's not a diet book! It just lays out the research and the myths. Excellent book, BTW - I just started reading it, and I'm engrossed - almost as much as with this thread.

I have not read the book yet, I agree with what I heard him say last night, (what he could get in!) EXCEPT for the statement that exercise does you no good. It made my hackles go up, thinking how that type of advice sounded like Kimkins. Correct me if you think I am wrong, but exercise is necessary for weight loss, I have never had success without it.

I agree .... I was very disappointed that they never gave him a chance to talk. I thought the moderator was horrible! Big disappointment as far as I was concerned.

What was interesting was the info on exercise. Gosh my doctor told me that in the early '70's. He told me not to exercise until I lost my weight - exercise increases insulin and insulin increases appetite. Hmmmm!

LOL When we moved there, my mom said there were only two directions, up and down! My dad was a pastor and moved to another church while I was in college. I've only been back once since then on a trip to CA to get away after my first husband died. That was 21 years ago and in the summer. The Victorian Christmas must have started after I went to college. I don't remember it, but what a wonderful town for something like that.

Thanks so much for explaining this for most of us who don't understand the legal process. Some Playground gals want to be outside of the attorney's office when Kimmer walks in. Obviously, she would have to make an appointment with John (attorney) to make her deposition so they could have a court reporter there, etc. So, it would be "cool" to know when that would happen.

Attorney hours are very expensive ($250 plus an hour), so if Kimmer were smart she would avoid the trial and make a settlement right away. Anyway, she will have to pay HER attorney fees, so that makes me feel good..and hopefully Jeanessa's fees, too..

It's all about patience right now and waiting on the system.

There was no way to link from the success stories to the user name like the success stories posted here at LCF. They were all in a seperate area and with NO user info.
It was all chaotic over there when I joined and everything was a mess with Newbies everywhere asking the same questions over and over. I tried it for a few weeks and KNEW that KK was not for me. As I finally looked around and found the answers to questions, I did not like what I was seeing. (21 day water fast was the post that was the final straw for me!!!!)

I thought they had just "left the site" onto their new skinny lives. There were others on the site who were chatting that were very very close to their own goal. It was enough for me.

I would post if I were sure she was going. Someone mentioned that she could give her deposition in her attorney's office? Anybody have confirmation of where she has to appear?
