Yes we were in Panama and I was elated because I use to live there when I was younger. It was a 10 night trip out of Tampa.

Right. According to Judge Cunnison's 10/18 order, the deposition will take place in Tiedt's office.

The way I read the docs, this phase of discovery is mainly related to the Motion for Writ of Attachment (attempt to secure assets to cover potential judgment). The judge's order says this initial deposition & document request is limited to: 1) witnesses, documents, and assets related to the Kimkins business, 2) identity of past & current kimkins owners, 3) names, addresses and phone numbers of the models appearing in the Kimkins success story photographs (HAHAHAAHAHA they'll all be very long distance numbers!), and 4) information related to Kimkins membership income.

So....if this does happen this morning, it's JUST the beginning.

so...I'm curious. Does she have to go in at a certain time today or just waltz in whenever she pleases? I'm wondering if she had to call and set up an appointment or if they told her what time to come in.

She would have received a Notice of Deposition with the exact date, place & time to appear. And a list of documents to bring with her. I thought I saw somewhere that the start time was 8:30 AM but I can't find it now.

While this takes place outside a courtroom, it is a formal process, with everything taken down by a court reporter and a transcript generated. The transcript of the deposition is not a "public" document, and while the parties will be privy to it, the rest of the world would probably not see it unless and until it is submitted as an attachment to a motion or response to a motion - or unless it ends up in evidence at some other point during litigation.

ETA - And if she doesn't show up, Plaintiffs' counsel would most likely file a Motion to Compel, seeking an order of the Judge compelling her to appear at a new date & time.

I don't know how long documents take to get uploaded though. There might be some lag time there. I'm sure it would be by appointment. I had to make a sworn statement for a law case once, and it was not a "just show up" kinda deal. However, I am sure that Hideykims doesn't have the same sense of the imperative that I did!

You are right it does start at 8:30am today at the lawyers office. Here is what it say in the minutes from Oct 18th;

It is only 9:30 a.m. here in CA. Don't know what time she has been requested to appear. Long day for you guys on the East Coast, alreay 12:30 there so I guess you may be up late tonight to see if there is news as to if she shows or not. I doubt she will and would be very surprised if she does. However, she is sick and just might show and try to lie her way out of it all.
