I would think whomever technically owned the site at the time of fraud would be liable. (AGAIN, not a lawyer here). The question is who actually owns the site, esp if Heidi is still getting disability pay.
Say I was your friend, and you wanted to open a corporation, but you wanted to hide ownership from your lyin cheatin spouse (ermh, this IS hypothetical, I'm sure your DH is a saint), you might come up to me and say, "Hey, I'll give you 20% of the profit for doing nothing but being the figurehead on my company. The other 80% can be put in this bank account in the Caymans to this name right here. (Putting name on slip of paper and handing me the account number.) As long as the corporation or business pays its taxes and I get paid, there really isn't a lot that will come to the attention of the IRS ( I know that there are specific reporting rules depending on what type of business you are, but I don't know what the requirements are so I might be oversimplifying it and not being a criminal mastermind I'm sure there are other steps needing to be taken to wash the money). Here is the sticky wicket though...all of a sudden my corporation sold something that created a lawsuit, and the company is being sued. You're not even an employee...I own the company...guess who the courts are going after? There I am holding the bag. Eventually I might be able to convince someone at my expense to track the money and it ends up going to you, but possibly not. Dummy corporations are set up all the time with a fall person already at the helm. This is why I keep wondering, and would need a lawyers confirmation, who actually would end up being liable if she had it all set up in her son's name. Well, now that I'm banned, I requested a refund twice through the tech support link and both were closed with no response, so I hit the BBB and Attorney general.
Consumer Alerts, Information & Complaints - California Dept. of Justice - Office of the Attorney General is the complaint site for the AG ffice for whoever elae wants a refund. I sent it to The Truth too. |

It doesn't matter if someone else currently owns the company, the suit is against the person[s] who were involved in creating the fraud.
